If Landlord Does Not Give 24 Hours Eviction, Is It Illegal Eviction?
I Got The Boot From An Apartment Because The Rent Was Late, Got A Note On My Door At 4Pm To Move Out By The Next Day, So I Got A Uhaul And Was Already Moving By 6Pm, The Landlord Came Out And Made A Big Deal About It Saying It Was Just A Scare Tactic And That I Did Not Have To Move Out. She Then Got Upset Wtih Not Provacation And Told Me To Leave The Keys In Her Mail Box By Midnight. I Was Tired Of Working 9 Hour Shift And Moving All Day So I Came Back The Next Morning At 7 Am Before She Got To The Complex To Clean The Rest Of My Apartment, She Danm Near Kicked The Door Down And Was Yelling To Me To Get Out And She Was Calling The Police If I Did'Nt Leave, Then Took Pictures Of The Mess I Had Left From Moving While Looking At Me And Laughing All Crazy Saying Its Going On My Credit. I Told Her I Was Cleaning It And She Said &Quot; No! Nobody Ever Cleans You Are Lying! Get Out!&Quot; So I Left. Point Being She Did Not Even Give Me 24 Hours To Move Out And Clean And Is Trying To Charge Me For The Mess That Was Left Behind. Is This Illegal? Holy crap this is wrong on so many levels.

The second a tenant is late in paying rent, the landlord can issue a 3 or 5 day (depends on state) notice to pay up or get out. But even after that point, they still must go through the court to legally evict the tenant; there is nothing they can do legally to force the tenant to move.

What your landlord did is called a "self-help" or "constructive" eviction and is illegal in ALL states. There is nothing she can do, unless she sues you for backrent, in which case it will impact your credit. As it stands right now, the only negative you have incurred is a bad reference.

I am definitely not tolerant when it comes to tenants paying late, but what she did is flat-out illegal and wrong. You are within your rights to sue her, although it may be worth it to you just to be done with this crazy woman.

EDIT: I wouldn't worry about her coming after you for the cost of leaving the place a mess; it is her own damn fault. If she does try to file a claim against you for this, then counter-sue for the constructive eviction. Judges hate, hate, hate when people take the law into their own hands; you will almost certainly win. She probably knows this, so her threats are completely empty. Just wash your hands of her, and if she decides to escalate things, then retaliate.

Unfortunately, there is nothing you can do to forewarn other tenants. Legally, you cannot interfere with her rights to re-rent the house. However, if you do end up in court with her and she loses, this goes on public record, which anyone can look up. Tenants should always attempt to research private landlords like this to see if they've lost cases before.
